Genesee County Prosecutor David Leyton's Office has decided not to press charges against a Flint woman after she shot and killed her live-in boyfriend who had unexpectedly returned home early from work.

According to the police investigation, Dustin Leo Newton was shot and killed by his girlfriend around 7:45 a.m. on January 24, 2012 at their home on Bradley Avenue near Reynolds in the city of Flint. According to the girlfriend, Newton was working first shift and his early and unexpected return home from work caused her to mistake him for an intruder since the home had recently been broken into. She also stated that her boyfriend had previously showed her how to use the gun, which was registered to him, for protection.

"Based upon a thorough review of the police investigation and all the circumstances present, and our belief that this woman sincerely and reasonably believed the person entering her residence was a criminal intruder, we have decided not to file charges against her," said Leyton.
