The State Court of Appeals this morning issued a ruling that a local judge abused his power when sending someone to prison. According to Morning Gazette Radio host Mike Killbreath, Genesee Circuit Court Judge Archie Hayman had sent attorney F. Anthony Lubkin to prison for eating lunch at a restaurant while on break from court. The restaurant also happened to be the same place that jurors for a murder case before Hayman were eating at. Hayman had accused Lubkin of talking with the jury while there and fined him $250 and sentenced him to 30 days in jail. The State Court of Appeals overturned the conviction.
